Last updated: 24 September 2026
Overview
This website is operated by ARIA HAIR (ABN 29 622 728 349). Throughout these terms, "we", "us" and "our" refer to ARIA HAIR. We offer this website, including all information, tools and services available through it (our "Services"), subject to these Terms of Service.
By visiting our website, booking an appointment or purchasing from us, you agree to these Terms of Service ("Terms"), together with the policies referred to in them, including our Privacy Policy, Cancellation Policy, Refund Policy and Shipping & Returns Policy. Please read these Terms carefully. If you do not agree with them, please do not use our website or Services.
Our website is hosted on Squarespace, and our online bookings are managed through Phorest.
Nothing in these Terms excludes, restricts or modifies any rights you have under the Australian Consumer Law or any other law that cannot be excluded (see Section 14).
Section 1: Using our website
By agreeing to these Terms, you confirm that you are at least 18 years old, or that you are using our website with the involvement and consent of a parent or guardian.
You must not use our website, products or Services for any unlawful purpose, or in a way that breaches any law, including copyright laws. You must not transmit any viruses or code of a destructive nature.
We may suspend or restrict your access to our website or Services if you seriously or repeatedly breach these Terms.
Section 2: General conditions
We may decline to provide a service or accept a booking where we reasonably believe it is necessary, for example where a service would be unsafe for your hair or scalp, where a patch test indicates a reaction, or where a client has behaved abusively towards our team or other clients.
Card payment information is encrypted when transmitted. Other information you send through our website may pass across various networks and may not always be encrypted.
You must not reproduce, copy, sell or exploit any part of our website, including our images, text, logos and branding, without our written permission.
Headings in these Terms are for convenience only and do not affect their meaning.
Section 3: Accuracy of information
We work hard to keep the information on our website accurate and up to date. However, content on our website is provided for general information only and may occasionally be incomplete or out of date. Hair results, colour outcomes and extension results shown on our website and social media are examples only, and your results will depend on your natural hair, history and aftercare.
Section 4: Changes to services and prices
Our prices and services may change from time to time. Price changes will not affect bookings that have already been paid for, or products and gift cards you have already purchased. Service prices listed as "from" are a starting point, and your final price will be confirmed during your consultation or before your service begins.
We may modify or discontinue parts of our website or Services at any time.
Section 5: Products and services
We take care to display the colours and images of our products and extension shades as accurately as possible, but we cannot guarantee that your screen will display colours accurately. For extensions, we recommend an in-salon consultation for professional colour matching.
We may limit the quantities of products we sell or discontinue a product at any time.
For your safety, some colour and chemical services may require a patch test before your appointment. Following our aftercare advice, including maintenance appointments for extensions, helps protect your hair and your results.
Refunds for services are handled in accordance with our Refund Policy. Delivery, returns and exchanges of products purchased online are handled in accordance with our Shipping & Returns Policy. Both are subject to your rights under the Australian Consumer Law.
Section 6: Bookings and cancellations
Appointments can be booked online, by phone or in salon. Cancellations, rescheduling, no-shows and late arrivals are governed by our Cancellation Policy, which forms part of these Terms. Please provide accurate information when booking, including any allergies, sensitivities or relevant hair history, so we can provide your services safely.
Section 7: Gift cards and memberships
In line with Australian gift card laws, our gift cards are valid for at least three years from the date of purchase, and the expiry date is clearly displayed on each gift card. We do not charge any fees to activate, use or redeem a gift card. Gift cards can be used towards our services and products, and cannot be exchanged for cash, except where required by law. Please treat gift cards like cash, as we cannot replace lost or stolen cards unless they can be verified.
Blow Dry Memberships are subject to the terms provided at the time of purchase, including the period in which appointments must be used.
Section 8: Orders, billing and account information
We may refuse or cancel an order, or limit quantities purchased per person or per order, for example where stock is limited, where an order appears to be placed for resale, or where there is a pricing or product error. If we change or cancel your order after payment, we will contact you and provide a full refund for any amount we cannot fulfil.
Products purchased through our online store are subject to our Shipping & Returns Policy, which sets out delivery times, shipping costs and how to return or exchange a product.
You agree to provide current, complete and accurate information for all bookings and purchases, and to update your details if they change, so we can complete your transactions and contact you as needed.
Section 9: Third-party tools and links
Our website may include tools, booking systems or links provided by third parties, such as Phorest, payment providers and social media platforms. These third parties are not controlled by us, and their own terms and privacy policies apply to your use of them. To the extent permitted by law, we are not responsible for third-party websites, content or services.
Section 10: Comments, feedback and other submissions
If you send us feedback, suggestions, reviews or other content ("comments"), you agree that we may use, edit and publish them without obligation to pay compensation or keep them confidential. We will only publish your name or photos with your consent. You agree that your comments will not be unlawful, abusive, defamatory, misleading or infringe anyone's rights, and will not contain viruses or malicious code. We may remove content that we reasonably consider breaches these Terms.
Section 11: Personal information
Your personal information is handled in accordance with our Privacy Policy.
Section 12: Errors, inaccuracies and omissions
Occasionally, information on our website may contain errors relating to descriptions, pricing, promotions or availability. We may correct errors and update information at any time. If an error affects an order you have already placed, we will contact you before proceeding and give you the option of a full refund.
Section 13: Prohibited uses
You must not use our website or its content: (a) for any unlawful purpose; (b) to encourage others to carry out unlawful acts; (c) to breach any law or regulation; (d) to infringe our intellectual property or the intellectual property of others; (e) to harass, abuse, defame, intimidate or discriminate against anyone; (f) to submit false or misleading information; (g) to upload or transmit viruses or malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, scrape or crawl our website; or (j) to interfere with or circumvent the security of our website. We may restrict your access to our website or Services if you engage in any prohibited use.
Section 14: Australian Consumer Law and limitation of liability
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service, you are entitled to cancel your service contract and receive a refund for the unused portion, or compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with goods or a service does not amount to a major failure, you are entitled to have the problem rectified in a reasonable time, and if this is not done, to a refund for the goods or to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to compensation for any other reasonably foreseeable loss or damage from a failure in the goods or services.
Nothing in these Terms excludes, restricts or modifies those guarantees or any other rights you have under the Australian Consumer Law.
Subject to those rights, and to the extent permitted by law:
we do not guarantee that our website will be uninterrupted, secure or error-free;
we are not liable for any indirect or consequential loss arising from your use of our website; and
where our liability for a failure to comply with a consumer guarantee can lawfully be limited, it is limited to supplying the goods or services again, or paying the cost of having them supplied again (for services), or replacing or repairing the goods, or paying the cost of doing so (for goods).
Section 15: Indemnity
You agree to indemnify ARIA HAIR against any claim made by a third party, including reasonable legal costs, to the extent it arises from your breach of these Terms or your violation of any law or the rights of a third party. This indemnity is reduced to the extent that the claim was caused or contributed to by our own negligence or breach.
Section 16: Severability
If any part of these Terms is found to be unlawful, void or unenforceable, that part will be severed and the remaining provisions will continue to apply.
Section 17: Termination
These Terms apply until terminated by you or us. You may stop using our website and Services at any time. We may restrict your access to our website or Services if you seriously or repeatedly breach these Terms. Any amounts owing up to the date of termination remain payable, and any rights you have under the Australian Consumer Law are not affected.
Section 18: Entire agreement
These Terms, together with our Privacy Policy, Cancellation Policy, Refund Policy, Shipping & Returns Policy and any other policies posted on our website, form the entire agreement between you and us regarding your use of our website and Services. If we do not enforce any right under these Terms, that does not mean we have waived it.
Section 19: Governing law
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
Section 20: Changes to these Terms
We may update these Terms from time to time to reflect changes to our business or the law. The current version, with the date it was last updated, will always be available on this page. Changes will not apply to bookings or purchases made before the change was published.
